Terms of Use

Effective Date: September 27, 2026 · Version 2026-09-27

Please read these Terms of Use ("Terms") carefully before using QuizStack.ai (the "Service"), operated by <<OWNER: legal entity name (e.g. QuizStack, Inc.)>> ("QuizStack.ai", "we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms.

PLEASE NOTE: These Terms include a binding arbitration agreement and a class-action waiver (Section 19) that affect how disputes between you and us are resolved, and important limitations of our liability (Section 14). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms. If you do not agree with any part of them, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and handle your information (including how your content is processed by AI systems) and is incorporated into these Terms by reference.

2. Eligibility and Age Requirements

You must be at least 13 years old to create an account or use the Service. The Service is not available to anyone under 13, including with a parent's or guardian's permission. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

Accounts of users under 13. The first time you sign in, we ask for your birth month and year. If the answer shows that you are under 13, the account is closed immediately: it cannot be used, any share links it created stop working, and we delete it and the information associated with it. You can also delete it yourself straight away. If we otherwise learn that an account belongs to someone under 13, we will close and delete it. See the "Children's Privacy" section of our Privacy Policy.

If you use the Service on behalf of a school or organization, you represent that you are authorized to accept these Terms on its behalf.

3. Description of the Service

QuizStack.ai is an AI-powered study platform. Depending on your plan and the features enabled for your account, the Service lets you:

  • Add study sources: upload files (PDFs, Word and PowerPoint documents, text and Markdown files, images — including photos of handwritten notes — and audio recordings), paste text, add web links and YouTube video links, or import documents from Google Drive (optional, read-only).
  • Generate study materials from those sources using artificial intelligence — notes, quizzes, flashcard decks, and image-occlusion sets.
  • Get AI grading and feedback on your answers, practice math, and track progress through study streaks, concept mastery, review schedules, and study plans.
  • Receive optional push-notification study reminders, if you opt in.

The Service relies on third-party AI models (currently Google Gemini) to generate content and, if you turn on the optional AI Cross-check, on xAI's Grok API to review it. We are continually developing the Service: features may be added, changed, placed behind usage limits, or removed at any time.

4. Accounts

You sign in to the Service with an email address and password or with your Google account (authentication is provided by Google Firebase Authentication). You agree to provide accurate, complete, and current information and to keep it up to date.

You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately if you become aware of any unauthorized use of your account or any other breach of security.

We may suspend or terminate accounts that violate these Terms (see "Termination" below).

5. Your Content and Our License to Use It

5.1 You Own Your Content

"User Content" means the material you provide to the Service — uploaded files, pasted text, links, and imported documents. You retain all ownership and intellectual-property rights you hold in your User Content. Nothing in these Terms transfers ownership of your User Content to us.

5.2 License to Operate the Service

So that we can provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely for the purpose of operating and providing the Service to you. This expressly includes sending your User Content to our AI and document-processing providers (currently Google Gemini, Google Cloud Text-to-Speech, and Google Cloud Document AI) to generate your notes, quizzes, flashcards, and other study materials and to grade your answers, and — only if you turn on the optional AI Cross-check — to xAI's Grok API to review generated materials for accuracy. This license ends when you delete the content or your account, except to the extent limited copies persist in routine backups or as required by law.

5.3 Your Responsibilities

You are solely responsible for your User Content. You represent that you have the necessary rights to upload it and to grant the license above, and that it does not violate the law or the rights of others. Do not upload sensitive personal information, confidential material, or content you do not have the right to share.

5.4 Generated Study Materials

We do not claim ownership of the study materials the Service generates from your User Content. They are provided to you for your personal, non-commercial study use. You may not resell, license, or commercially distribute generated content without our prior written permission. Note that AI output may not be protectable by copyright and similar output may be generated for other users from similar sources.

6. Acceptable Use

You agree not to:

  • Upload or transmit content that infringes intellectual-property rights, violates any law, or is defamatory, harassing, hateful, or otherwise harmful
  • Upload content containing viruses, malware, or other harmful code
  • Violate the privacy or publicity rights of any third party
  • Attempt to circumvent generation limits, rate limits, plan restrictions, or feature flags
  • Probe, scan, or test the vulnerability of the Service, or access accounts, data, or systems you are not authorized to access
  • Scrape, crawl, or bulk-extract content from the Service, or use automated means to access it other than through interfaces we provide
  • Reverse engineer, decompile, or disassemble any part of the Service, except where such restriction is prohibited by law
  • Resell, rent, or provide the Service to third parties as a service bureau without our written consent
  • Interfere with or disrupt the integrity or performance of the Service

7. Copyright Complaints and DMCA Takedown

We respect the intellectual-property rights of others and expect our users to do the same. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA).

Notice. If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material you claim is infringing and enough information for us to locate it; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Designated agent: <<OWNER: DMCA designated agent — name, email, and mailing address (register the agent with the U.S. Copyright Office)>>

Counter-notice. If your content was removed and you believe it was removed in error, you may send a counter-notice to the same agent containing the information required by the DMCA (17 U.S.C. § 512(g)). Repeat infringers. We will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.

8. AI-Generated Content Disclaimer

IMPORTANT: The Service uses artificial intelligence to generate notes, quizzes, flashcards, grades, feedback, worked solutions, proofs, and other study materials. AI-generated content may contain errors, omissions, or fabricated information ("hallucinations"). Always verify generated material against your original sources or an authoritative reference before relying on it — especially before an exam.

You acknowledge and agree that:

  • Generated content is a supplementary study aid, not an authoritative source or a substitute for your course materials
  • AI-generated quiz answers, grades, feedback, and step-by-step solutions or proofs are approximations, may be incorrect, and are not official academic assessments; we make no guarantee that any generated answer, grade, or proof is correct
  • AI models are non-deterministic and may produce different results for the same input at different times
  • Generated content is not professional advice (medical, legal, financial, or otherwise), even when your sources cover those subjects
  • We are not responsible for academic, professional, or other consequences of relying on generated content

9. Third-Party Content and Services

The Service lets you work with third-party content and services — for example, YouTube videos you link, web pages you import, and documents you choose to import from Google Drive. Your use of those services is subject to their own terms, and you are responsible for having the right to use the content you bring into the Service.

We do not control, endorse, or assume responsibility for third-party content or services, and we are not liable for any loss or damage arising from your use of them.

10. Intellectual Property

The Service itself — its software, design, features, and original content (excluding your User Content and your generated study materials) — is and remains the exclusive property of <<OWNER: legal entity name (e.g. QuizStack, Inc.)>> and its licensors, protected by copyright, trademark, and other laws. Our name, logo, and trade dress may not be used without our prior written consent.

11. Subscriptions, Billing, Auto-Renewal, and Refunds

Paid subscriptions are not generally available at this time. The following terms will apply if and when we offer paid subscriptions, and any additional disclosures presented at checkout will control:

  • Recurring charges and auto-renewal. Paid plans are offered on a recurring subscription basis (for example, monthly). Unless stated otherwise at checkout, your subscription automatically renews at the then-current price at the end of each billing period until you cancel, and your payment method is charged at the start of each period. We will disclose the price, billing frequency, and renewal terms clearly before you subscribe and obtain your affirmative consent to the recurring charge.
  • Cancellation. You may cancel at any time through your account settings or the billing portal — using at least as easy a method as you used to subscribe. Cancellation stops future renewals; it takes effect at the end of the current billing period.
  • Price and term changes. We will give you advance notice of any change to your subscription price or material terms before it takes effect, as required by applicable law, and an opportunity to cancel.
  • Refunds. Except where required by law, subscription fees are generally non-refundable and there are no refunds or credits for partial billing periods. Any specific refund terms will be presented at the time of purchase.
  • Payment processing. Payments are processed by Stripe; your card details are handled by Stripe and never stored on our servers. You authorize us and Stripe to charge your payment method for the fees you incur.
  • Taxes. Stated prices may not include applicable taxes, which will be added where required.

12. Plans, Limits, and Availability

Generation features consume third-party AI capacity, so the Service enforces fair-use limits (such as daily generation and request rate limits) that vary by plan. We may adjust these limits to keep the Service reliable and sustainable.

We do not guarantee that the Service will be available at all times. Generation may occasionally be slow, degraded, or temporarily unavailable — for example, when upstream AI providers are at capacity. We may suspend the Service for maintenance or modify or discontinue features at any time.

13. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT GENERATED BY IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUIZSTACK.AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE OR ANY CONTENT GENERATED BY IT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE, OR, IF GREATER, ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless <<OWNER: legal entity name (e.g. QuizStack, Inc.)>>, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content, your use of the Service, or your violation of any rights of a third party.

16. Educational Use and Academic Integrity

The Service is intended for personal educational use. You agree not to use the Service or its generated content for:

  • Academic dishonesty, cheating, or plagiarism
  • Submitting AI-generated content as your own original work where that is prohibited
  • Any purpose that violates the academic-integrity policies of your school or institution

You are solely responsible for ensuring that your use of the Service complies with the policies of your educational institution or organization.

17. Termination

We may suspend or terminate your account and access to the Service, without prior notice or liability, if you breach these Terms, if we are required to do so by law, or if we discontinue the Service.

You may stop using the Service at any time. You can delete your sources, notes, quizzes, and flashcard decks in the app, and you can request deletion of your entire account and its data as described in our Privacy Policy.

Provisions that by their nature should survive termination — including ownership, warranty disclaimers, indemnification, limitations of liability, and the dispute- resolution and arbitration terms — survive termination.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of <<OWNER: governing-law U.S. state (e.g. Delaware)>>, and applicable U.S. federal law, without regard to its conflict-of-law provisions. Subject to the arbitration agreement below, any dispute not subject to arbitration shall be brought exclusively in the courts located in <<OWNER: venue — county + state / courts for non-arbitrable disputes>>, and you consent to their jurisdiction.

19. Dispute Resolution; Binding Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY TRIAL.

Informal resolution first. Before starting an arbitration or lawsuit, you agree to try to resolve the dispute informally by contacting us at <<OWNER: general/legal contact email — suggest legal@quizstack.ai>> and giving us at least 30 days to resolve it.

Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, administered by <<COUNSEL REVIEW: arbitration administrator + rules (e.g. AAA Consumer Arbitration Rules / JAMS) and seat>>, rather than in court, except that either party may bring a qualifying claim in small-claims court, and we may seek injunctive relief to protect our intellectual-property rights in any court of competent jurisdiction. This agreement is governed by the Federal Arbitration Act.

Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to <<OWNER: general/legal contact email — suggest legal@quizstack.ai>> stating your name and that you opt out of arbitration. If any portion of this Section is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable, this entire arbitration Section will be void.

20. Changes to These Terms

We may modify these Terms from time to time. If a change is material, we will make reasonable efforts to provide notice (for example, on this page or in the app) before it takes effect, and we will update the effective date and version above. By continuing to use the Service after revised Terms take effect, you agree to be bound by them. If you do not agree to the new Terms, stop using the Service.

21. Severability and Entire Agreement

If any provision of these Terms is held unenforceable or invalid, it will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy and any other legal notices we publish on the Service, constitute the entire agreement between you and <<OWNER: legal entity name (e.g. QuizStack, Inc.)>> concerning the Service.
